RESUMO: Dentro do contexto social tem-se a aplicação do direito. A partir dos postulados neoconstitucionalistas, a dignidade humana e os direitos fundamentais são alçados à base essencial dos Estados Democráticos, cabendo, quanto a estes, atender e garantir a efetividade imediata do núcleo da dignidade humana, o chamado mínimo existencial. O presente artigo tem por objetivo apresentar os argumentos fundantes e a necessidade de efetividade imediata dos direitos fundamentais inseridos no mínimo existencial. PALAVRAS-CHAVE: Dignidade.
