Resumo

RESUMO O presente artigo tem como objetivo analisar sob o prisma histórico e hermenêutico a polêmica obra Tópica e Jurisprudência, de Theodor Viehweg, que traz como tema principal, a relevância da tópica para a Ciência do Direito, retomando a temática da interpretação jurídica por outro viés, ou seja, não mais mediante os clássicos instrumentos de interpretação, sendo estes insuficientes aos anseios de solução às questões hermenêuticas do Direito na atualidade, todavia, partindo da filosofia clássica de Aristóteles e Cícero, abre novos horizontes para as Ciências Jurídicas, onde a hermenêutica e interpretação do Direito se tornam mais próximas da realidade social dinâmica. ABSTRACT This article has for finally discuss about the point of view historical and hermeneutical the controversial work Topic and Jurisprudential , of Theodor Viehweg, that bring as the main theme, the relevance of the topic for the Legal Sciences, Revisiting the themes of the legal interpretation on the other way, in other words, no longer through the classics interpretative instruments, these being insuficiente to the desires of solution to hermeneutical problems of the Law in the presente, however, starting with classical philosophy of Aristoteles and Cicero, opens new horizons for the Legal Sciences, where the hermeneutical and interpretation of the Law become more near of the dynamic social reality.
