A BOA-FÉ OBJETIVA E OS DEVERES ACESSÓRIOS DE CONDUTA NAS RELAÇÕES CIVIS E CONSUMERISTAS

Resumo

RESUMO: A boa-fé é um dos princípios mais mencionados no ordenamento jurídico. Como representa uma cláusula-geral, sua utilização possui aspectos positivos e negativos. A boa-fé se divide tradicionalmente em duas: a subjetiva e a objetiva, sendo a última a base para a proibição do comportamento contraditório, analisada neste artigo de forma desvinculada da expectativa. Trazemosuma nova perspectiva para a boa-fé objetiva, a pró-ativa. Examinamos a diferença entre deveres típicos, secundários e acessórios de conduta e, para finalizar, a divisão clássica dos últimos em deveres de lealdade, informação e proteção e como eles se encontram no Código Civil e no Código de Defesa do Consumidor. Since represents a general clause, the utilization of the principle has positive and negative aspects. The good faith is tradicionally divided into two categories: the subjective ans the objective, being the last one the basis for the prohibition of a contracditory behavior, analised in this article detached from expectation. We bring a new perspective on the objective good-faith: the pro-active one. We examine the difference between tipical, secondary and acessories of conduct duties. To finalize, the classical divition of the last duties into duty of loyalty, informations and protection and their treatment in civil and consumers Law.
