FRAUDE À CONSTITUIÇÃO O problema da infração indireta à norma constitucional

Resumo

RESUMO: A inconstitucionalidade por infração indireta à norma constitucional, ou simplesmente fraude à Constituição, é um expediente utilizado amiúde e que consiste em frustrar a aplicação da norma constitucional por meio artificioso. Caracteriza-se pela ofensa à Constituição por via oblíqua. Trata-se de um fenômeno percebido a partir da fraude à lei, cujo reconhecimento independe da intenção do agente, especialmente do legislador. A doutrina e a jurisprudência vêm batizando a fraude à Constituição como desvio de finalidade, desvio de poder legislativo, desvio de poder constituinte e atalhamento constitucional. Faz-se premente resgatar a nomenclatura “fraude à Constituição”, a que melhor define o fenômeno. Há iterativos precedentes judiciais declarando a inconstitucionalidade de leis em fraude à Constituição, embora sem mencionar, necessariamente, esse nome. Há inúmeras outras leis a serem mencionadas que configuram fraude constitucional e que sequer foram questionadas sob esse prisma. É importante aprofundar o estudo da fraude à Constituição, seja para melhor identificar os atos normativos que padecem de vício de inconstitucionalidade por fraude, seja para unificar a nomenclatura relativa ao tema. O aprofundamento do estudo sobre esse problema só irá contribuir para o enriquecimento dos métodos de controle de constitucionalidade. PALAVRAS-CHAVE: Fraude. Infração. Indireta. Constituição. ABSTRACT: The unconstitutionality of indirect infringement to the constitutional rule, or simply Constitution fraud, is a device used often and that is to frustrate the application of the constitutional rule through artificial means. It is characterized by the offense to the Constitution by oblique means. It is a phenomenon seen from the breach of the law, whose recognition is independent of the agent’s intention, especially the legislator. The doctrine and the jurisprudence are baptizing the fraud to the Constitution as deviation of purpose, misuse of legislative power, misuse of constitutional power and Constitution shortcut. It is urgent to rescue the expression “breach of the Constitution” that best defines the phenomenon. There are iterative judicial precedents declaring the unconstitutionality of laws in breach of the Constitution, though, not necessarily mentioning that name. There are numerous other laws to be mentioned that shape constitutional fraud that were not even questioned in this light. It is important to deepen the study of fraud to the Constitution, either to better identify the normative acts that suffer from unconstitutionality addiction for fraud, or to unify the naming on the subject. The in-depth study on this issue will only help to enrich the methods of judicial control on unconstitutionality.
