O PRINCÍPIO DA IRREDUTIBILIDADE DO VALOR DOS BENEFÍCIOS COMO PRESERVAÇÃO DA DIGNIDADE DA PESSOA HUMANA

Resumo

RESUMO: Este trabalho tem como objetivo principal analisar se o fator previdenciário e a nova regra introduzida pela Lei n° 9.876/99 para o cálculo do salário de benefício, bem como os diversos índices adotados ao longo dos anos para o reajuste das aposentadorias e pensões têm causado perda do poder aquisitivo dos aposentados e pensionistas, e consequentemente, contrariado o Princípio da Dignidade da Pessoa Humana. Para cumprir tal intento, o presente trabalho foi exposto em três partes descritas a seguir: na primeira parte, foram avaliados o Princípio da Dignidade da Pessoa Humana e a importância dos Direitos Fundamentais, como instrumento de proteção ao indivíduo; na segunda parte, foram abordados o surgimento da Seguridade Social e seus seguimentos, e as prestações continuadas: aposentadorias e pensões; na terceira parte, foram analisados a situação econômica dos brasileiros, as Teorias do Mínimo Existencial e da Reserva do Possível, e, por fim, o Princípio da Irredutibilidade do Valor dos Benefícios como meio de preservação do poder aquisitivo dos aposentados e pensionistas. Além dessas três partes foram inseridos Apêndices que contêm simulações do cálculo da renda mensal inicial de uma aposentadoria por tempo de contribuição. PALAVRAS-CHAVE: Dignidade da Pessoa Humana. ABSTRACT: This study aims to analyze if the Social Security benefit formula and the new method introduced by the Law nº9.876/99, to calculate the benefit salary as well as the different indicators used over the years, in order to adjust the retirement and pension plans, have been responsible for the loss of the purchasing power of the retired workers and pensioners and consequently have been disrespecting the Human Dignity Principle. In order to achieve this goal, the present study was conceived into three parts, as follow: in the first part, were evaluated The Human Dignity Principle and the importance of the Fundamental Rights, as a means of protecting the human being; in the second part, were focused the beginning of the Social Security system and its segments, and the retirement and pension plans; in the third part, were analyzed the Brazilian financial situation, the Existential Minimum, the Reserve of the Possible and finally, the Principle of the Irreducibility of the Benefit Values as a means of preserving the purchasing power of the retired workers and pensioners. Besides, were inserted Appendices which contain a simulation of the calculation of the initial monthly Social Security benefit based on the length of contribution. KEYWORDS: Human Dignity Principle.
