Resumo

RESUMO: O presente trabalho tem como desígnio abordar sobre a concessão do direito à visita íntima como garantia ligada à dignidade da pessoa humana, tratando do direito que as reeducandas possuem, não sendo este uma regalia que, portanto possa ser negociada. Introduzir a noção e a materialização ao Princípio da Igualdade. Abordar os motivos que levam a uma desmedida diferenciação entre os homens e mulheres encarcerados. Empreender uma visão de que a imposição da abstinência sexual contraria a finalidade de ressocialização, pois o contato social é fundamental para seu alcance. Demonstrar o descaso das unidades prisionais construídas para a população feminina, por falta de uma política pública. Constatar a invisibilidade e vulnerabilidade a que estão relegadas contribuem para a discriminação dos direitos e garantias fundamentais. Comprovar que o direito à visita íntima é uma garantia fundamental e não uma regalia, que pode ser livremente disposta. Abordar sobre a opressão das condições de encarceramento para as mulheres no sistema penitenciário brasileiro. Demonstrar que as encarceradas sofrem limitações indevidas no tocante ao direito da visita íntima. PALAVRAS-CHAVE: Visita íntima. Princípio da Igualdade. Dignidade Humana. Gênero. ABSTRACT: The present work is to approve the granting of the right to intimate visit as a guarantee linked to the dignity of the human person, dealing with the right that the reeducated have, not being a perks that can therefore be negotiated. Introduce the notion and the materialization to the Principle of Equality. Address the motives that lead to an inordinate differentiation between incarcerated men and women. Undertake a view that the imposition of sexual abstinence is contrary to the purpose of resocialization, since social contact is fundamental to reach. Demonstrate the neglect of the prison units constructed for the female population, due to the lack of a public policy. Noting the invisibility and vulnerability to which they are relegated contributes to the discrimination of fundamental rights and guarantees. Prove that the right to an intimate visit is a fundamental guarantee and not a gift, which can be freely arranged. Addressing the oppression of conditions of imprisonment for women in the Brazilian penitentiary system.
