Resumo

RESUMO: O presente estudo dedica-se à discussão sobre o Jusnaturalismo de Santo Tomás de Aquino e suas implicações na contemporaneidade. Nesse sentido, realizamos um estudo da influência do pensamento do filósofo medieval para a concepção do direito brasileiro hodierno, especialmente, dos direitos fundamentais constitucionais, baseados na dignidade da pessoa humana. Dessa forma, foi oportuna a análise dos conceitos de direito, ética e moral como ponto base e introdutor, para que se pudesse fazer uma distinção desses aspectos que nos ajudaram a compreender o tema com maior clareza e objetividade. Nesse diapasão, observamos, num segundo momento, a evolução histórico-filosófica do pensamento acerca do direito e da moral a partir das teorias de pensadores desde a Antiguidade até a Idade Média. Ao fim do trabalho, abordamos mais a fundo a relação existente entre preceitos constitucionais atinentes à proteção à vida e à dignidade humana e o jusnaturalismo tomista, levando em consideração a legislação, doutrina e jurisprudência brasileiros. Nessa esfera, buscamos contribuir com as abordagens referentes aos direitos fundamentais constitucionais, visando a sua proteção e resguardo em nosso ordenamento jurídico, a fim de que o processo evolutivo da sociedade não implique na modificação desses direitos de forma a prejudicar o homem, mas, a protegê-lo. ABSTRACT: The current study is dedicated to the discussion about Saint Thomas Aquinas's Natural law and its implications in contemporaneity. In this sense, we did a study of the influence of the medieval philosopher's thoughts in the conceiving of the modern Brazilian Law, especially of the fundamental constitutional rights, based on the dignity of the human person. Thus, it was convenient to analyze of the concepts of right, ethics and morals as a starting and introductory point, so that there could be a distinction of the aspects that helped us understand the subject with more clarity and objectivity. In this regard, we see, in a second moment, the historical and philosophical evolution of thoughts about right and morals from the theories of thinkers since the Antiquity up until the Middle Ages. At the end of this paper, we address more deeply the relationship between the constitutional precepts pertinent to the protection of life and of human dignity and Thomas Aquinas's Natural law, taking into account the Brazilian legislature, doctrine and jurisprudence. Concerning this, we seek to contribute to the approaches regarding the fundamental constitutional rights, aiming to protect and shelter them in our legal order, so that society's evolutionary process doesn't imply in the modification of these rights in a way so the man is harmed, but protected instead.
