PRAGMATISMO JURÍDICO, ATIVISMO JUDCIAL E POLÍTICA PÚBLICA

Resumo

RESUMO: Este artigo pretende apresentar uma abordagem filosófico-pragmática dos fenômenos denominados ativismo judicial e política pública, tendo como análise prática a atuação do Tribunal de Justiça do Estadual de Alagoas em sede de 2º grau na concretização e tutela de políticas públicas de saúde em face do Poder Executivo estadual. Pretende-se averiguar se nesses casos há ou não uma atuação ativa na perspectiva filosófico-pragmática dos membros das Câmaras Cíveis do referido órgão jurisdicional. Assim, busca-se propor uma compreensão destes fenômenos, tendo como método e teoria a filosofia pragmática de Oliver Wendell Holmes e Benjamin N. Cardozo. PALAVRAS-CHAVE: Pragmatismo Jurídico. ABSTRACT: This article presents an approach to philosophical and pragmatic phenomena called judicial activism and public policy, with the practical analysis of the action the Court of the State of Alagoas in the seat of 2nd degree in the implementation and supervision of health public policy in the face the State Executive Power. It is intended to ascertain whether or not these cases there in an active role in the philosophical and pragmatic perspective of these phenomena, with the method and theory to pragmatic philosophy of Oliver Wendell Holmes and Benjamin N.
