Para tratar deste tema abordaremos na primeira parte a questão dos direitos sociais. Um dos aspectos mais relevantes é discussão sobre o direito ao mínimo existencial e a proibição do retrocesso. Em seguida, abordamos a questão das políticas públicas de saúde dando enfoque ao controle exercido pelo judiciário e aos princípios da separação dos poderes e a reserva do possível. E assim, finalizando com o tema, judicialização do direito à saúde no fornecimento de medicamentos e a efetividade do princípio da supremacia do interesse público, a fim de verificar se a atuação do judiciário estaria protegendo o interesse coletivo ou agravando a situação daqueles que necessitam da atuação do Estado. Supremacia do interesse público.ABSTRACT: This article deals with the interference of the judiciary in the control of public health policies in the supply of medicines. To address this issue we discuss in the first part of the question of social rights. One of the most important aspects is discussion about the right to a minimum existential kick and ban. Then, we address the issue of public health policies focusing the control exercised by the judiciary and the principles of separation of powers and possible reserves.
