O DIREITO PENAL NA SOCIEDADE CAPITALISTA SEGUNDO UMA PERSPECTIVA PÓS-MODERNA

RESUMO: A perspectiva pós-moderna trouxe para o Direito novas formas de lidar com um mundo ocidental fragmentado pela carência de ideologias e crenças. Há consequências para o Direito Penal, devido à insegurança nas vidas dos cidadãos. Foram investigadas as mudanças no âmbito processual, nos sujeitos de direito e a postura dos magistrados perante as mudanças de visão social de mundo. Palavras-chaves: Pós-modernidade. Risco ABSTRACT: The postmodernist perspective has brought to Law new ways to lead with the fragmentary occidental world, which has a huge lack of ideologies and believes as its paradigm. There are consequences to Criminal Law, because of the insecurity in the citizens lives.
