OS EFEITOS DA EMENDA CONSTITUCIONAL Nº 64/2010 NO DIREITO DE FAMÍLIA

Resumo

RESUMO: O presente trabalho interpreta o conteúdo da nova Emenda Constitucional nº 64, de 04 de fevereiro de 2010, que eleva textualmente o direito à alimentação à categoria de direito constitucional, no art 6º da Constituição Federal. Nesse prisma, ressoa evidente que a novel situação do direito à alimentação vem reforçar o compromisso do Estado brasileiro na erradicação da pobreza, no âmbito interno e externo, efetivando a plena realização de uma série de tratados internacionais ratificados pelo Brasil. Ademais, grande impacto terá no direito de família, alavancando a solidariedade familiar, através da ampliação do conceito de família e das obrigações e assistências no tocante à alimentação entre os componentes das unidades familiar. Direito à alimentação ABSTRACT: This work interprets the content of the new constitutional amendment nº 64, of 4th February 2010, that recognizes the right to food to the category of constitutional law, at the art 6 of the Federal Constitution. Accordingly, it is clear that the new situation of right to food reinforces the commitment of the Brazilian State on the eradication of poverty, domestically and internationally, put totally into practice many international treaties ratified by Brazil. Moreover, it will have a huge impact on the Family Law, increasing family solidarity, through the expansion of the concept of family and of the obligations and aids with regard to food among the components of family units.
