A DEFENSORIA PÚBLICA COMO INSTRUMENTO DE EFETIVAÇÃO DOS DIREITOS HUMANOS

RESUMO: O artigo destaca a missão constitucional da defensoria pública de assegurar aos hipossuficientes de recursos o acesso à justiça e realça a necessidade de fortalecê-la como instituição essencial à função jurisdicional do Estado. Registra o autor um voto exarado pelo Dr. Antônio Augusto Cançado Trindade, então juiz da Corte Interamericana de Direitos Humanos, reconhecendo a relevância do direito de acesso à justiça, e debruça seu olhar sobre as prisões, nas quais a atuação do defensor público se torna imprescindível para a defensa dos direitos do recluso e, de igual modo, a cobrança ao Estado de sua obrigação de adequar as condições do cativeiro aos standards previstos pelas Regras Mínimas da ONU. ABSTRACT: The article highlights the constitutional mission of public defenders to assure to the underprivileged people the access to justice and underlines the need to strengthen it as an essential institution to the jurisdictional function of State. The author mentions a vote written by Dr. Antônio Augusto Cançado Trindade, at that time judge of the Inter-American Court of Human Rights, recognizing the importance of the right of access to justice, and focuses his gaze on the prisons, in which the role of public defender becomes imperative for the defense of the rights of the inmates and the adjustment of the conditions of captivity to the standards set by the UN Standard Minimum Rules.
