PRIVAÇÃO DE LIBERDADE POR TRANSGRESSÃO DISCIPLINAR MILITAR

RESUMO: O presente artigo tem por objetivo fomentar discussão acerca da imprescindibilidade da privação da liberdade do militar, por transgressão disciplinar, em face de permissivo constitucional que a autoriza. Discorre-se sobre a sujeição especial do cidadão militar à hierarquia e disciplina, sua relação com o Estado e o comprometimento de seus direitos fundamentais individuais, máxime no que concerne à liberdade, um dos pilares da dignidade humana. ABSTRACT: This research aims to foster a discussion about the eventual inevitability of the deprivation of personal liberty of military personnel, in situations of disciplinary transgression, in view of the authorizing constitutional provision. The study discourses on how the military workforces are to undergo the required hierarchy and discipline, their relation with the State and the compromising of their individual rights, above all with regard to personal freedom, one of the pillars of the human dignity.
